Privacy policy
This page sets out what data the site collects, why it is needed, how long it is kept and how to have it deleted. Written to meet the GDPR, the European data protection regulation.
The Polish version of this policy is the legally binding one.
Who is responsible for the data
The data controller is Fernaxis, NIP 1133196356, Warszawa, Polska. For any question about your data, write to fernaxis.landscape@gmail.com.
What we collect and why
| What | Data | Why | Legal basis |
|---|---|---|---|
| Enquiry from the form "A conversation about your plot" | name, contact (phone, Telegram, WhatsApp or email), plot size, town, task, how you heard about us, the utm tag of the visit | to answer the enquiry and prepare for the conversation | Art. 6(1)(b) GDPR, steps taken at your request before a contract; Art. 6(1)(f), correspondence and defence against possible claims |
| Subscription to "letters about gardens" | to send occasional letters about gardens | Art. 6(1)(a) GDPR, your consent given when subscribing | |
| Visit statistics | aggregated view counters, with no cookies and no visitor identifiers | to see which pages get read | Art. 6(1)(f) GDPR, legitimate interest |
| Server logs | IP address and technical request data when pages load | running and securing the site | Art. 6(1)(f) GDPR, legitimate interest |
Two fields in the form are required: name and contact. Without them we cannot reply. The rest are optional: fill them in if you would like the conversation to start closer to the point.
Who else sees the data
- Cloudflare, Inc., the infrastructure of the site: hosting and the storage that enquiries and subscriptions go into. Cloudflare processes the data on our instructions (the Cloudflare Data Processing Addendum); where data leaves the European Economic Area, the standard contractual clauses of the European Commission (SCC) apply.
- Telegram (Telegram Messenger Inc. / Telegram FZ-LLC): the studio owner learns about a new enquiry from a Telegram notification, which contains the fields you filled in. Telegram may process data outside the EEA under its own policy: telegram.org/privacy.
The data goes to no one else and is never sold. There are no ad networks and no trackers on this site.
How long we keep it
- Enquiries that did not turn into work: 12 months after the last contact, then deleted.
- If a contract was signed, we keep its data for as long as the law and the limitation periods require: up to 6 years (Article 118 of the Polish Civil Code), accounting documents for 5 years from the end of the tax year.
- A subscription address: until you unsubscribe or ask us to delete it.
Your rights
Under the GDPR you can:
- ask for access to your data and a copy to take elsewhere
- correct it or have it deleted
- restrict the processing or object to it
- withdraw consent to the letters at any time (processing before the withdrawal stays lawful)
An email to fernaxis.landscape@gmail.com is enough. We answer within a month at the latest, as the regulation requires, usually sooner.
Where to complain
If you believe we are handling your data incorrectly, you have the right to complain to the Polish supervisory authority: Prezes Urzędu Ochrony Danych Osobowych, ul. Stanisława Moniuszki 1A, 00-014 Warszawa, uodo.gov.pl. But write to us first, we will most likely sort it out faster.
Cookies and browser storage
The site sets no cookies, neither its own nor advertising ones. That is why there is no cookie banner here: there is nothing to agree to.
A draft of the form is saved in your browser (localStorage) so the text is not lost if the page closes by accident. The draft is not sent to us and is cleared once the form goes through.
Visit statistics are counted without cookies and without visitor identifiers, only aggregated numbers such as "how many times a page was opened".
Automated decisions
There is no profiling and no automated decision making with legal effects on you on this site.
Changes
The policy may be updated along with the site; the version in force is always on this page. In force since 20 July 2026.
